It’s important to register
your business name (fictitious name) so that no
one else can use it. And registering your
business name is a simple procedure which anyone
can do.
If you’re starting your business as a sole
proprietorship then in most states you can
register your business name with your county
clerks’ office or with your state government
office.
You’ll have to register your business name as
your DBA (doing business as). And a DBA
statement is all you’ll need to start your
business as a sole proprietorship.
You can dial 411 and ask for the phone number
for your local county clerks’ office for your
county.
And then contact the county clerks office for
exact procedures, forms and total filing fees
which can cost anywhere from $10 to $35. |

You may be required to conduct a search through
your state fictitious name data base in order to
make sure that no one else is using the name
which you are trying to register. (Some state
and local departments may do the actual name
search for you).
After the availability of your business name has
been confirmed, then you can proceed to request
the business name registration forms or download
the forms from the county clerks’ website for
your county or from your state governments’
website.
Fill out the registration forms and then mail
them in with the appropriate filing fees to your
county clerks’ office. |

And then wait for your name
statement which confirms that you are now the
owner of that business name and that your
business name is now registered and in use so
that no one else can use it.
In some states, you may be required to place an
ad in your local news paper in order to make
known to the public the ownership and use of
your new business name.
Then you can proceed to submit the proof of your
publication to your local county clerks’ office
to prove compliance of their publication
requirements.
Local news papers publicize business name
registrations on a regular bases so they’re
already familiar with the process. And they’ll
be more than happy to assist you place your ad
in their news paper as well.
When forming your business as a corporation,
partnership or limited liability company, your
business name becomes registered with the state
when you file your articles of corporation or
statement of partnership with the state.
And you can file your articles/forms of
corporation, partnership or Limited Liability
Company with your Secretary of State Department
or the Department of Corporations for your
state.
